2. SUBJECT
This Sales Agreement covers the rights and obligations of the parties in accordance with Law No. 6502 on Consumer Protection and the Distance Contracts Regulation (Official Gazette: 27.11.2014/29188), related to the sale and delivery of the product(s) listed below that the SELLER has sold to the BUYER. By accepting this agreement, the BUYER acknowledges in advance that, upon confirming the order, they are obligated to pay the product price and any additional fees such as shipping or taxes and that they have been informed accordingly.
3. ESSENTIAL QUALITIES AND PRICE OF GOODS/SERVICES (INCLUDING VAT)
3.1 The basic features of the products (type, quantity, brand/model, color, quantity) are listed on the seller's website www.elieyusha.com. These can be reviewed during the campaign period. Prices are valid until the end of the campaign.
3.2 The listed and advertised prices on the website are the sales prices. They remain valid until updated or changed. Time-limited prices are valid until the end of the specified period.
3.3 The total sale price including all taxes is shown in the table below.

Invoice Delivery: The invoice will be sent to the BUYER along with the product.
4. DELIVERY AND METHOD
The contract becomes effective upon electronic confirmation by the Buyer, and fulfillment occurs when the Seller delivers the product to the Buyer. Delivery will be made to the address and authorized persons specified in the order form and this contract.
5. DELIVERY COSTS AND FULFILLMENT
Unless otherwise stated, delivery costs are borne by the Buyer. If the Seller has declared that they will cover the delivery fee on the website, then the Seller pays for shipping. Delivery is made if stock is available and payment has been made. The Seller delivers within 30 days unless otherwise agreed. If payment is not made or is canceled by the bank, the Seller is not obliged to deliver the product.
If the Buyer cancels after the product has been shipped but before it is received, the Buyer is responsible for the shipping cost.
6. BUYER DECLARATIONS AND COMMITMENTS
The Buyer declares they have read and acknowledged the preliminary information about the product on the website, including its basic features, price, payment, delivery, and shipping costs. By confirming the contract and preliminary info form electronically, the Buyer confirms that this information was provided. The Buyer is responsible for inspecting the product upon delivery. If they accept damaged items (broken, torn packaging, etc.), they accept full responsibility. If the product is misused by third parties after delivery, the Buyer is responsible. If payment is not made to the Seller due to unauthorized credit card use, the Buyer must return the product within 3 days.
7. SELLER DECLARATIONS AND COMMITMENTS
The Seller is responsible for delivering the product in full, undamaged, and per the stated specifications, along with warranty certificates and manuals if applicable. If force majeure prevents delivery, the Seller must inform the Buyer within 3 days. If delivery is to someone other than the Buyer and is refused, the Seller is not responsible.
8. RIGHT OF WITHDRAWAL
8.1 In distance sales, the Buyer may withdraw from the contract without legal or penal liability and without providing any reason within 14 days of receiving the product. In service contracts, the period starts from the signing date. If service delivery has started with consumer approval, the right of withdrawal cannot be used. Return shipping costs are borne by the Seller.
8.2 To use the withdrawal right, written notice must be sent via registered mail, fax, or email within 14 days. The product must not fall under "non-returnable items". If used:

8.2.1 The original invoice must be returned (if issued to a business, a return invoice must be issued).

8.2.2 A return form must be completed.

8.2.3 The product must be returned complete with box, packaging, accessories, undamaged.

8.2.4 The Seller must refund the Buyer within 14 days after receiving the withdrawal notice.

8.2.5 If the product is damaged due to Buyer’s fault, compensation is required.

8.2.6 If the withdrawal causes the order to fall below a campaign threshold, discounts are canceled.

8.2.7 Custom-made or personalized products cannot be returned.
9. DISPUTE RESOLUTION
Disputes arising from this contract will be resolved by Consumer Arbitration Committees or Consumer Courts in the Buyer's residence area, depending on the monetary limits set by the Ministry of Customs and Trade.
10. PRICE OF THE PRODUCT
The final price (whether cash or in installments) is in the order form, email confirmation, and invoice. Discounts, coupons, and shipping fees are reflected in the final price.
11. DEFAULT AND LEGAL CONSEQUENCES
If the Buyer defaults on credit card payments, they will be responsible for interest and bank/legal costs as per their credit agreement. The Buyer is also liable for any damages the Seller suffers due to delayed payment.
12. NOTIFICATIONS AND EVIDENCE AGREEMENT
All communication between the parties will be conducted via email, except where the law requires otherwise. The Buyer agrees that electronic records kept by the Seller will be binding, conclusive evidence in disputes and accepts this under Article 193 of the Code of Civil Procedure.
13. ENFORCEMENT
This contract, consisting of 13 clauses, has been read and electronically approved by the Buyer on ………………. and has become effective.
